Terms of service
Last changed on 6 October 2026. These terms are the contract between you and Haydamax OÜ for Sponge hosting, mail and domains. They are written to be read once, in full, without a lawyer.
Who you are buying from
Sponge is a service of Haydamax OÜ, registry code 17351554, Narva mnt 5, 10117 Tallinn, Estonia. Invoices come from that company. Write to support@sponge.digital for anything about your account, and to abuse@sponge.digital about content hosted with us.
What a plan includes
Each plan is a number of sites, disk, mailboxes, PHP workers and backup retention, published on the plans page. Those numbers are the contract: PHP workers and mailboxes are hard caps, disk is measured every night, and CPU and memory are what the account is sized for on a shared server. Sites run on our own hardware in Falkenstein, Germany; mail runs on our own servers in Helsinki, Finland.
Price and renewal
The price you pay at the start is the price you pay at renewal. We do not use a discounted first period that jumps later. If we ever change a plan's price, the change applies from your next renewal and we tell you by email at least 30 days before it takes effect; you can cancel instead.
Haydamax OÜ is not registered for VAT, so no VAT is added to your invoice. If that changes, VAT will be shown separately on invoices from that date.
Hosting is prepaid, monthly or yearly. A yearly term is billed as ten months. Service starts when the invoice is paid, not when the order is placed.
Domains
Domains are registered through our registrar partner Openprovider (Hosting Concepts B.V., the Netherlands) and are subject to the rules of the registry for each zone and, for gTLDs, to ICANN policy. You are the registrant: the name belongs to you, not to us, and you can move it away.
Registration and renewal prices are shown on the name before you buy, both numbers when they differ. Some names are priced by the registry per name — those are marked “Premium” in the catalogue with their own price.
A domain fee is paid to the registry at the moment of registration and cannot be returned, so a registered domain is not refundable. Domains do not renew automatically unless you switch renewal on; we write to you before a name expires. A name that expires can usually still be restored for a registry fee during a short redemption period, which costs considerably more than a renewal.
A transfer away needs an auth code, which you get from the cabinet, and is free. Registry rules lock a name against transfer for 60 days after registration or after a change of registrant.
Cancelling, and the 14-day withdrawal right
You can cancel hosting at any time in the cabinet or by email; the service runs to the end of the period you paid for and is not renewed.
If you are a consumer in the EU, you have 14 days to withdraw from a distance contract. We start the service immediately at your request, so for a withdrawal inside those 14 days we return what you paid minus the part of the period already served. This does not apply to domain names: they are registered to your order at the registry and the fee is gone the moment they are.
Business customers do not have a statutory withdrawal right, and we do not grant one.
What we promise, and what we do not
We keep a nightly copy of your files and databases for the retention your plan names, and you can restore any of them yourself from the cabinet. Keep your own copy of anything you cannot lose: a backup is a convenience, not a guarantee.
We issue and renew TLS certificates for your sites and keep the platform patched. We do not promise an uptime percentage on these plans and we do not pay service credits — if you need a contractual SLA, write to us before you buy and we will say plainly whether we can offer one.
Support runs by email, Monday to Friday. We aim to answer the same working day, Business+ first. We do not promise a fixed response time on these plans and we do not run a phone line.
Your side of it
Keep your account details accurate — a registrant whose email bounces can lose a domain under registry rules. Keep your sites and their plugins updated: a site broken into through an old plugin is still your site, and the cleanup is your work, though we will tell you what we see. What you may and may not host is in the acceptable use policy, which is part of these terms.
We may suspend an account that threatens the server for everyone else — an outbound spam run, a site serving malware, a process eating the machine — and we will tell you why the same day. We delete data only after the account has been closed and the notice period in the closure email has passed.
Liability
We are liable for damage we cause intentionally or by gross negligence, and for anything the law does not let us limit. Beyond that, our liability for any claim is limited to what you paid us for the service in the twelve months before the claim. We are not liable for lost profit or lost data where you had no backup of your own.
Changes and law
If we change these terms, the current version is always on this page with the date above it, and we email registered customers about any change that affects what they pay or what they get. Estonian law applies. If you are a consumer, you keep the protection of the mandatory law of your own country, and you may take a dispute to the Consumer Disputes Committee in Estonia or through the EU ODR platform.
